Terms of Service

By creating an account or using SPYKFIT (“Service”) you agree to these Terms of Service. If you do not agree, do not use the Service. These Terms form a binding agreement between you and SPYKFIT (“we”, “us”).

You must be at least 13 years old to create an account. Users between 13 and 18 must use SPYKFIT with parental or guardian supervision, particularly when uploading videos that involve load progression.

You are responsible for ensuring you are physically able to perform the exercises in your training plan and any drills recommended by coaches. SPYKFIT does not perform a medical screening of users.

SPYKFIT provides:

• A free five-pillar movement assessment with AI-generated insights
• AI-generated movement profiles + a personalized training plan tailored to your limiting pillar
• On-demand expert reviews of customer-uploaded workout videos by certified coaches (paid feature)
• A close-the-loop satisfaction system, including follow-up questions and free re-reviews where appropriate

The Service is delivered as fitness coaching and educational content. It is not medical advice, diagnosis, or treatment. Coaches do not act as physicians, physical therapists, or licensed medical professionals.

Coach feedback is provided strictly for fitness coaching purposes. If you experience pain, dizziness, shortness of breath, joint instability, or any symptom suggesting injury or illness, stop immediately and consult a qualified medical professional. Do not rely on SPYKFIT or coach feedback to diagnose or treat any medical condition.

You acknowledge that physical exercise carries inherent risks, including injury. You assume all responsibility for performing exercises safely and within your current physical capacity.

• Keep your password confidential and use a strong password
• Do not share your account with others
• Notify us promptly if you suspect unauthorized access
• Provide accurate information during onboarding and assessment
• Do not impersonate another person or create accounts using false information

You retain ownership of all videos you upload (“User Content”). By uploading, you grant SPYKFIT a limited license to store the video, display it to your assigned coach and SPYKFIT administrators, and use it solely for the purpose of delivering the Service to you.

We do not use your videos to train AI models or share them with third parties beyond the providers necessary to deliver the Service (see our Privacy Policy).

You agree not to upload content that:

• Depicts or involves any person who has not consented to be filmed
• Violates any law or third-party right
• Contains nudity, sexual content, or content unrelated to fitness coaching
• Is intended to harass, threaten, or defame any person

We may remove content that violates these Terms and may terminate accounts for repeated violations.

The free tier (assessments, AI insights, training plans) is free to use indefinitely. Paid tiers and one-time review credits are billed through Stripe.

• Single Review — $19 one-time, grants 1 review credit. Pack credits never expire.
• Form Pack — $39 one-time, grants 3 review credits. Pack credits never expire.
• Membership Pro — $49/month subscription, grants 4 review credits at the start of each billing month. Membership credits expire at the end of the billing month they were granted (use them or lose them). Cancel anytime; pack credits remain in your account regardless of membership status.

Subscriptions auto-renew until canceled. You may cancel at any time from the Stripe-hosted billing portal accessible from your dashboard. Cancellation takes effect at the end of the current billing period; you retain access to remaining credits until they expire.

We reserve the right to change pricing with 30 days' notice. Existing subscriptions are honored at their original price until the next renewal after the notice period.

If a coach review is not useful to you, you may file a re-review request from the review detail page. We will route the same video to a different coach for a fresh review at no additional charge. If the re-review is also unsatisfactory, we will refund the credit (or the equivalent dollar value, at our discretion).

Subscription customers receive a pro-rated refund only at our discretion if exceptional circumstances apply (e.g. the Service was unavailable for an extended period). Otherwise, paid periods are non-refundable; cancel anytime to stop future charges.

Coaches on the SPYKFIT platform are independent contractors, not employees of SPYKFIT. SPYKFIT vets each coach's credentials but does not directly supervise their feedback. SPYKFIT facilitates the connection between you and the coach and handles billing, support, and quality control on your behalf.

You agree not to:

• Use the Service for any unlawful purpose
• Reverse-engineer, decompile, or attempt to extract source code
• Scrape, mass-download, or automate use of the Service without our written permission
• Submit content that infringes intellectual property rights
• Attempt to gain unauthorized access to any system or account
• Harass, abuse, or threaten coaches or other users

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” SPYKFIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT COACH FEEDBACK WILL ACHIEVE ANY SPECIFIC RESULT, PREVENT INJURY, OR FIT YOUR INDIVIDUAL CIRCUMSTANCES.

TO THE FULLEST EXTENT PERMITTED BY LAW, SPYKFIT'S TOTAL LIABILITY ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID TO SPYKFIT IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

IN NO EVENT WILL SPYKFIT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR PERSONAL INJURY ARISING FROM EXERCISES OR DRILLS PERFORMED IN RELIANCE ON COACH FEEDBACK.

You agree to defend and indemnify SPYKFIT and its coaches from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

You may terminate your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms, abuse the Service, or fail to pay applicable fees. Termination does not entitle you to a refund of pre-paid amounts except as set out in Section 8.

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after that period constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising from the Service must be brought in a state or federal court located in Delaware, and both parties consent to that jurisdiction.
